Terms of Use

By using castcms.com, the customer panel, or related services, you confirm that you have read and accept these Terms.

1. Parties

These Terms cover castcms.com, the customer panel, APIs, and related tools (the “Service”).

  • CastCMS / we / us — the business that operates the Service
  • You / Tenant — the person or organisation that registers or uses the Service

By creating an account, opening the panel, publishing a tenant site, or using the Service commercially, you accept these Terms, the Privacy Policy, the Disclaimer, and the KVKK notice. If you do not agree, do not use the Service.

2. What CastCMS is

CastCMS is only a data and content-management infrastructure. You use it to publish your radio, sports (ScoreCast), or data-API project on your domain (a “Tenant Site”).

CastCMS is not:

  • the publisher, editor, broadcaster, or journalist of your Tenant Site
  • a party to contracts between you and your visitors, listeners, advertisers, or customers
  • a search engine, ranking product, or indexing service
  • a betting operator, financial adviser, or payment institution
  • a guarantor of scores, stream uptime, traffic, or revenue

Plan features may change. Not every module is in every plan.

3. Platform shield

CastCMS is not responsible for content created by tenants, nor for betting or financial referrals.

You are solely responsible for:

  • all content, media, schedules, podcasts, match pages, widgets, ads, and metadata (“Your Materials”)
  • comments or other user-generated content you allow
  • betting, gambling, odds, tipster, or similar referrals
  • financial, investment, crypto, or credit advice or referrals
  • licences, age gates, and third-party rights (copyright, trade mark, personality)

Visitors contract with you, not with CastCMS. We do not review Your Materials before publication as a rule. We may remove or suspend content or accounts when these Terms or the law require it — that does not make us your publisher.

4. Account

  • You must be at least 18 (or the age of majority where you live, if higher)
  • Keep account details accurate
  • The Account Owner is responsible for staff, agencies, and subcontractors
  • Protect passwords, sessions, and API keys — we are not liable if you do not
  • If you sign up for an employer or client, you confirm you can bind them

5. Your Tenant Site

You run the Tenant Site: DNS, stream URLs, branding, and compliance where you offer it.

Publish on that site who operates it, how to contact you, and the privacy / cookie / terms your visitors need. CastCMS legal pages on castcms.com cover our Service, not automatically your Tenant Site.

You confirm you have the rights for Your Materials and any feed, stream, score, or API you connect.

6. Acceptable use

Use the Service only for lawful purposes. You must not:

  • publish illegal content (including child sexual abuse material or content that incites crime)
  • infringe intellectual property, privacy, or personality rights
  • run phishing, malware, spam, or unauthorised access
  • overload, scrape, or bypass plan limits
  • present CastCMS as the publisher or operator of your Tenant Site
  • use the Service for unlicensed betting, gambling, or regulated financial services

You bear legal and commercial responsibility for Your Materials and your Tenant Site. If you operate for a client, you remain primarily responsible.

7. Report illegal content

Use the public form Report abuse for alleged illegal or infringing content on a CastCMS-hosted Tenant Site. We require email confirmation. We log the IP address of the submission (not shown to the Tenant).

You may also email [email protected] with the URL, a short legal basis, your name and contact email, and a statement that the report is accurate.

Official authorities (court, prosecutor, police): do not use the public form. Send the letter or order to [email protected] from an institutional mailbox, with the documents. A dedicated law-enforcement portal may be added later.

We may notify the Tenant, disable the material, or suspend the account. We are not a court. General questions: [email protected] · Contact.

8. Third parties, streams, scores

Tenant Sites may depend on Icecast/Shoutcast, CDNs, sports-data vendors, payments, DNS, and email. Their outages, bad scores, broken streams, or policy changes are your risk. CastCMS does not warrant live-score accuracy or uninterrupted audio.

9. Fees

Fees follow Pricing or a written offer. Payment, renewal, cancellation, and refunds follow checkout / invoice texts. Unpaid or abusive accounts may be suspended. Mandatory consumer rights remain.

10. Intellectual property

CastCMS software, design, and brand stay with us. You keep Your Materials. You grant us a licence to host and technically process them only to run the Service (backups, CDN, abuse review). That licence ends when the material is deleted, except legal retention copies.

11. “As is” — no extra warranties

The Service is provided as is and as available. We do not warrant uninterrupted use, security, audience, ranking, stream quality, or revenue. Guides are operational aids, not legal or financial advice.

12. Liability cap

To the maximum extent permitted by law, CastCMS is not liable for lost profits, data, or reputation, or for indirect loss — including tenant content, betting or financial referrals, sports-data errors, or stream failure.

Our total liability is limited to what you paid us for the relevant Service in the 12 months before the event (or any higher mandatory minimum). Details: Disclaimer.

13. Indemnity

You will defend and hold CastCMS harmless from claims arising from your use of the Service, Your Materials, your Tenant Site, betting or financial content, or your breach of these Terms or the law.

14. Suspension and changes

We may suspend or end access for breach, illegal content, security, non-payment, or legal necessity. You may close your account, subject to paid-fee terms. Shield, liability, and indemnity clauses survive.

We may update these Terms. Continued use after a change means you accept the update.

15. Law and contact

Turkish law applies, subject to mandatory consumer and public-order rules.
